What To Do After a Personal Injury in North Charleston

With more than 300 years of combined legal experienceour attorneys have the knowledge and skill to handle any personal injury case. We know that, in many cases, the steps a person takes in the aftermath of an incident can have long-term consequences. If you were hurt in a North Charleston accident, you should try to take as many of the following steps as possible to protect your legal rights:

  • Report the accident. Regardless of the type of accident, report it to the proper authorities. If you are involved in a car accident, call 911 to summon the police and emergency medical services. For slip-and-fall accidents on commercial properties, make a written report to the property owner or manager as soon as possible. A written record of the accident can serve as crucial evidence.
  • Gather evidence. If you are able, use your phone to take pictures of your injuries, where the accident happened, and any noticeable hazards in the area. Speak to any witnesses who saw the accident and get their contact information. Take note of any surveillance cameras that may have recorded the accident. You should try to do this before you leave the scene, if it is possible. Critical evidence may disappear or deteriorate over time. If you cannot safely gather evidence, ask a family member or friend to do so for you.
  • Seek medical attention. See a doctor immediately after an accident. You should get medical attention even if you do not have visible injuries. For example, some people suffer serious brain injuries without showing any immediate symptoms. For the sake of your health, you should allow a medical professional to examine, diagnose, and treat you as soon as possible after an accident.
  • Keep copies of receipts and other records. Make copies of any bills, receipts, or invoices related to your injuries or other losses from the accident. This information could provide valuable evidence of the compensation you are owed.
  • Keep a pain journal. In addition to writing down your recollection of the accident, keep a pain journal. You can track how your injuries affect your daily activities and prevent you from doing things such as handling chores around the home or enjoying hobbies.
  • Stay off social media. Today, insurance companies routinely surveil an injury victim’s social media accounts to find evidence that could potentially undermine their claim. Anything you post online could be used against you. Be cautious. Do not say anything about your accident or injuries until your case is resolved.
  • Do not speak to any insurance companies. After an accident, you may receive a phone call from an insurance company. The person on the phone may seem friendly. However, insurance companies are for-profit businesses. They will try to save money by undervaluing your claim. If an insurance company contacts you, be polite, but tell them to talk to your lawyer.
  • Hire a personal injury attorney. If you have suffered injuries in an accident, too much will be at stake to handle the case yourself. A North Charleston personal injury attorney at Joye Law Firm can help you pursue the money you need for medical bills, lost wages, and other expenses. We can communicate with the insurance companies and other parties on your behalf while you focus on recovering from your injuries.

How Our North Charleston Attorneys Can Help

Our attorneys at Joye Law Firm are committed to assisting you in every aspect of your injury case. If you have been seriously injured, your focus should be on your recovery. We can review the details of your accident and explain your legal options free of charge. We will give you our honest assessment of whether you have a valid personal injury claim.

If we believe your case has merit, our North Charleston personal injury lawyers will offer to represent you on a contingency fee basis. You will not owe a legal fee unless we are successful in obtaining money for you through a settlement or jury verdict. We understand that you and your family are going through a stressful time financially if you have been seriously injured and do not have money to pay a lawyer.

We will help see that you get the medical care you need. We can help you get referrals to medical specialists and physical therapists.

We investigate each case thoroughly and prepare it as if it is going to trial. That preparation gives us command of the facts and lets us advocate on your behalf from a position of strength.

We will gather your medical bills and other expenses and estimate any future medical care or living assistance you will need as a result of your injuries. We will estimate the income you have lost as a result of the accident. All of these losses and expenses should be reflected in the accident claim.

Our accident attorneys at Joye Law Firm will work to identify all the parties that are potentially responsible for your injuries and the insurance policies available to provide compensation. This is an important step in the claims process. In some cases, more than one party contributed to a car accident or other personal injury accident. Identifying multiple potentially liable parties can increase the amount of insurance compensation available to cover your losses. We will prepare and submit a claim reflecting the full cost of your injuries.

If you have unpaid medical debt, we will contact your doctor and hospital and let them know that a legal claim is pending. Many healthcare providers will hold off on the collection process if they understand that litigation that may cover the medical bills is in process. We will also work to reduce the amount you owe by as much as possible.

We will negotiate aggressively with the insurance companies. Insurers often make initial lowball offers to limit their liability, but you do not have to accept a low offer. If we receive a settlement offer in your case, we will discuss it with you and provide guidance about whether it is a reasonable amount. We will keep you updated on our progress on your case and remain accessible to you if you have questions.

We settle most car accident cases without going to trial. However, our willingness to go to court when necessary, and our success in presenting our cases to juries mean that insurance companies are more likely to offer a full settlement to avoid a trial. That allows us to obtain maximum value for our clients.

Results We’ve Achieved for Clients

In a complex personal injury case, two sisters suffered severe and permanent injuries as passengers in a Tesla accident in Charleston, handled by Attorney Mark Joye of Joye Law Firm. The case involved challenging negotiations with the Cincinnati Insurance Company, which initially understated the available insurance coverage, and resulted in a $2,417,500 settlement after two years of litigation.

This case highlights the importance of skilled legal representation in personal injury cases, particularly when facing difficult insurance companies, and marks a triumph for the sisters, who can now focus on their future careers inspired by their experience. Read more about this case.

In another case, a truck driver represented by Joye Law Firm attorney Ryan LeBlanc received a

$1.25 million workers’ compensation settlement after suffering serious injuries from a falling 1,000 lb. roll while working for Mercer Transportation Co.

The case’s central dispute revolved around whether the driver was an employee or an independent contractor, with LeBlanc successfully arguing for the former based on employer control and the nature of the relationship. The settlement, reached on May 19th, 2022, highlights the potential for workers incorrectly labeled as independent contractors to receive compensation under the S.C. Workers’ Compensation Act.

What Are Recoverable Damages for a Personal Injury in North Charleston?

People who suffer injuries in accidents through no fault of their own may seek just compensation for their financial and personal losses. In a typical personal injury case, you may possibly seek damages such as:

  • Medical costs related to treating your injuries, including doctor’s visits, prescription drugs, hospital stays, lab work, physical therapy, and medical equipment
  • Incidental expenses, such as mileage for travel to and from medical appointments
  • Lost wages if you cannot work while recovering from your injuries
  • Loss of future earning capacity if your injury results in a permanent disability
  • Physical pain and suffering
  • Emotional distress
  • Diminished quality of life due to your injuries

Joye Law Firm strives to recover maximum compensation for our clients in every case. We can review your case and evaluate the types of compensation that may be available to you.

What Is the Time Limit for Personal Injury Lawsuits in North Charleston?

Under South Carolina law, the deadline to file a personal injury lawsuit is typically three years from the date of the accident. There are some exceptions, however. For example, the deadline for medical malpractice claims is three years from the date when the injury was discovered or reasonably should have been discovered. The deadline to file a lawsuit against a local or state government agency is two years from the date of the accident, and could require earlier notice to protect the statute of limitations.

Speaking to an experienced personal injury attorney immediately after an accident is essential. If you miss the filing deadline, you could lose your opportunity to seek compensation. A lawyer at Joye Law Firm can keep track of deadlines and file paperwork on your behalf to protect your legal rights.

How Is Liability Determined in a Personal Injury Claim in North Charleston?

Typically, the plaintiff in a personal injury case must prove that the defendant’s actions contributed to the accident that injured them. Lawyers may use various pieces of evidence to prove liability in a personal injury case. Some of the most common types of evidence include:

  • Medical records
  • Photos and video from the accident scene
  • Eyewitness statements
  • Expert testimony from medical professionals or accident reconstruction experts
  • Surveillance footage from nearby businesses or homes
  • Police accident reports
  • Footage from traffic cameras or dashcams
  • Cell phone records, employment records, and driving records

What Compensation is Available After a North Charleston Car Accident?

The value of your case will be determined by a number of factors including the specific facts, the severity of your injury, and the types of losses you have suffered.

South Carolina allows victims of car accidents to seek compensation for expenses related to injuries caused by another’s negligence. The compensation may include:

  • Medical expenses
  • Lost wages
  • Physical therapy
  • Future loss of income
  • Long-term disability
  • Pain and suffering or emotional distress
  • Disfigurement

It is often difficult to think clearly amid the pain and disruption after a serious accident. It is important to have legal guidance you can trust.

If the car accident occurred while you were on the job, you may also be eligible to pursue a workers’ compensation claim.
