Owners of sports bars and restaurants along South Carolina’s Grand Strand should take note. Investigators are putting a full-court press on the owners of a sports bar in South Florida where a deck collapsed during the NBA finals on June 14, plunging dozens of people into the waters of Biscayne Bay.

Authorities say at least 33 people were injured, including two who were in serious condition. One couple has filed suit, saying the restaurant had a duty to properly maintain its property.

Owners of restaurants and bars are responsible – within reason – for the safety of their customers while they are on their premises. If a defective or dangerous condition causes injuries or if the business was negligent in failing to fix a problem, the business may be held liable.

An unanswered question in the Florida deck collapse is whether the deck was capable of accommodating the approximately 100 people who were on it at the time. Authorities were likely to look into whether the owners ignored safety inspections and whether they had made recommended repairs.
