$4,576,142 settlement for fatal auto accident that left a man paralyzed before he passed

Every decision behind the wheel carries the potential to change someone’s life forever. A moment of distraction, a failure to slow down, or a reckless choice can leave innocent people facing consequences that last far beyond the crash itself. In an instant, a person can lose their health, their independence, and, as this heartbreaking case demonstrates, even their life.

With his client facing an unimaginable choice, Attorney Jeff Gerardi knew there was little margin for error. This case would hinge on his legal skills, bold action, and capacity to shoulder his client’s burdens.  Where lesser attorneys may have cracked under the pressure, Gerardi stood firm in his resolve and determinedly pushed the case to successful conclusion.

Inattentive Driver Rear-Ends Stopped Vehicle

Our client, a 44-year-old man, was stopped in traffic on an Interstate 26 on-ramp when another driver approached too fast and crashed into the back of his vehicle. The tremendous force of the impact pushed his vehicle into the one in front of him, trapping him in the middle of a three-car collision.

When emergency responders arrived, he was conscious and able to speak, but he knew something was terribly wrong as he had lost feeling in his legs and his left arm.

He was rushed to Trident Medical Center, where doctors quickly discovered the collision had caused catastrophic injuries that would permanently change the course of his life.

Neck Injury Leads to Paralysis

Doctors diagnosed him with multiple traumatic injuries, including a cervical spinal cord contusion at the C3-C4 level and a subdural hematoma. The spinal cord injury left him permanently paralyzed from the neck down.

Emergency neurosurgeons performed a five-hour operation that included a cervical discectomy, insertion of an allograft, and placement of an anterior cervical plate in an effort to stabilize his spine.

The surgery saved his life, but it could not reverse the devastating damage to his spinal cord.

When he awoke, he faced a future he never imagined. He would never walk again. He would never regain the use of his arms. Every aspect of his life would require around-the-clock care.

As devastating as those realities were, another burden immediately weighed on his mind.

He had no health insurance.

As he struggled to process the trauma of the crash and emerge from the haze of anesthesia, he found himself wondering how he would ever pay for the enormous medical bills already accumulating or the expensive, lifelong care his injuries would require.

Eleven Days of Pain, Uncertainty, and Heartbreak

Over the next several days, his condition continued to deteriorate.

After initially leaving intensive care, he aspirated and was rushed back to the ICU. His health rapidly declined as he developed septic shock and was placed into a medically induced coma.

When doctors eventually woke him, they presented him with an impossible choice.

He could undergo a tracheostomy and feeding tube placement, accepting a future dependent on life support and complete paralysis, or he could allow nature to take its course.

After enduring eleven days of unimaginable pain and suffering, he made the heartbreaking decision to be removed from life support and passed away shortly thereafter.

Attorney Jeff Gerardi Uncovers Hidden Insurance Coverage

As our client’s condition worsened and those closest to him struggled to cope with an unimaginable tragedy, Attorney Jeff Gerardi prepared for the shifting reality.

At first glance, the available insurance coverage appeared limited.

The at-fault driver’s $100,000 automobile liability policy fell far short of covering the devastating losses resulting from the catastrophic injuries and wrongful death that resulted from the collision.

Attorney Jeff Gerardi refused to rest until he was sure every available avenue for compensation was investigated.

Jeff Gerardi Headshot

Gerardi’s intensive investigation revealed that the at-fault driver was acting within the course and scope of his employment when the crash occurred. That discovery dramatically changed the case.

Because the driver was working at the time of the collision, his employer’s commercial insurance policy became available, providing an additional $1 million in liability coverage along with a $10 million umbrella policy.

Recognizing the strength of the case and the significant damages involved, Attorney Gerardi strategically pursued a Tyger River demand, calling on the insurance company to pay its available policy limits. By leveraging South Carolina’s bad-faith insurance law and demonstrating the overwhelming liability and damages, he positioned the case for a successful resolution without unnecessary delay.

By relying on his sharp legal skills and years of experience, Gerardi’s careful investigation and legal strategy transformed what initially appeared to be limited to a $100,000 case into one with millions of dollars in available insurance coverage.

A $4,576,142 Settlement for a Family Forever Changed

Attorney Jeff Gerardi ultimately secured a $4,576,142 settlement on behalf of the client’s estate.

While no amount of compensation could erase the pain of losing a vibrant man in the prime of his life or undo the suffering he endured during those final agonizing eleven days, the settlement provided accountability and responsibility for an unimaginable tragedy.

Jeff and his client bonded over their mutual love of their pet dogs. During his hospitalization and despite what he was facing, our client’s primary concern were his beloved dogs, two Cane Corsos, who were being cared for by Charleston Animal Society while he fought for his life. After his passing, CAS went above and beyond to ensure the dogs’ health and well-being came first as they transitioned into a new reality.  Jeff knew how much the organization’s compassion meant to his client during his final days. To pay it forward, Joye Law Firm Injury Lawyers donated $100,000 to the Charleston Animal Society in our client’s memory. The gift continues to support the organization’s ongoing mission to care for vulnerable animals and families facing difficult circumstances.

At Joye Law Firm Injury Lawyers, we understand that catastrophic injury and wrongful death cases are about far more than insurance policies and legal claims. They are about honoring lives, holding negligent parties accountable, and ensuring every available source of compensation is uncovered. Our attorneys conduct thorough investigations, uncover every available source of compensation, and fight tirelessly to help clients and their families obtain the justice and financial recovery they deserve after life-changing collisions.
