A refusal does not stop a case. Under South Carolina law, refusing a breathalyzer or blood test can still lead to a suspended license and may be noted in the police report. In a civil lawsuit, refusal can support an argument that the driver was trying to avoid test results and may be paired with other signs of intoxication.
