How We’ve Helped Our Clients

In a case managed by Attorney Tommy Terrell of Joye Law Firm, a 60-year-old Myrtle Beach man with a pre-existing back condition received a $450,000 settlement after being rear-ended by a reckless driver.

Despite initial challenges due to the client’s pre-existing condition, Terrell’s strategic use of an updated MRI was crucial in linking the accident to the client’s worsened back pain, leading to successful negotiations with both the at-fault driver’s insurance and the client’s own Underinsured Motorist policy. The case underscores the importance of selecting the right attorney and the role of detailed medical evidence in securing fair compensation in personal injury claims, especially when pre-existing conditions are involved. Read more about this case result.

In another case, a Joye Law Firm client, an executive chef at a Myrtle Beach resort, was injured on the job and initially had his workers’ compensation claim denied due to a coworker’s statement about preexisting back issues.

Attorney Matt King and Case Manager Kayla Ashley successfully contested this, leading to a $150,000 settlement covering lost wages and medical care, as the chef is still unable to return to his previous position. The case highlights the complexity of workers’ compensation claims in South Carolina and the importance of seeking legal assistance early to navigate the system effectively and secure the rightful benefits. We get to know our clients and their families, take a personal interest in helping them regain the quality of life they enjoyed before the accident, and, most of all, we are proud to be part of the Myrtle Beach community. Call the Joye Law Firm to have one of our Myrtle Beach personal injury attorneys review the details of your accident and explain your options for moving forward. The initial consultation is free. You will not owe a legal fee unless we are successful in obtaining money for you.

We handle personal injury claims and deal with insurance companies every day. From years of experience working on many cases, we have developed a general sense of what an injury case should be worth depending on the factors. If you are dealing with an injury claim on your own, you may not have a clear idea of what is a reasonable settlement offer. Insurance companies will often make low offers to try to limit their liability. They know you are feeling financial stress and may feel pressure to accept whatever offer is put on the table.  The offer may even sound like a substantial sum at first glance, but will not cover all your medical bills or future expenses if you have ongoing medical costs.

Will I Have to Go Through a Trial in Horry County Court If I File an Injury Lawsuit?

Our personal injury lawyers at Joye Law Firm settle most cases without a trial. A settlement avoids the uncertain outcome of a trial and allows you to receive the money you need more quickly. However, if an insurer refuses to agree to a reasonable settlement, our attorneys will be prepared to seek justice for you in court if necessary. We are confident in our trial skills based on having won significant jury awards in a number of accident cases. Insurance companies are familiar with our reputation as trial lawyers. That makes them more willing to offer fair settlements to avoid the expense and risks of a trial.

How Long Does a Myrtle Beach Personal Injury Case Take?

The amount of time it takes to resolve a personal injury case depends on several factors including the complexity of the case, the court’s schedule, and whether the case is settled out of court. Our Myrtle Beach personal injury attorneys may be able to resolve your case in a matter of months if an out-of-court settlement can be obtained. However, if the case requires a complex investigation and the other side is unwilling to settle, it may take a year or longer to resolve. Some defense law firms will not seriously discuss a settlement until after a trial date is set.

If we receive a settlement offer, we will discuss it with you and offer our assessment of whether it represents a reasonable offer. It will be your decision about whether to accept the offer or proceed with the lawsuit. Some complex cases that go to trial take two to three years to complete. Each case has its own set of factors that determine the timetable. However, we understand that this is YOUR case, and you will always be in control of it. We will advise you on what we believe is your best interest, but the decision on whether or not to settle your case will always rest with you.

Frequently Asked Questions About Personal Injuries in Myrtle Beach

A personal injury lawyer advocates for clients who have suffered harm due to the careless actions of another person, company, or entity. They fight to secure compensation for their clients’ losses through negotiations or formal lawsuits.

Personal injury attorneys handle cases stemming from incidents like car crashes, defective products, medical mistakes, nursing home abuse, slip-and-fall accidents, and workplace injuries. If someone else’s negligence directly caused you physical, emotional, or financial damage, a personal injury lawyer can likely help.

Reach out to a Myrtle Beach injury law firm as soon as possible after an incident, even if you aren’t yet prepared to take legal action. An initial consultation allows an attorney to review your situation, explain your rights, preserve evidence, and monitor deadlines. However, even if time has passed, you may still have options, so contact a lawyer when you’re ready.

Most personal injury firms, including the Joye LawFirm, work on a contingency fee basis, meaning no payment is required upfront. The lawyer receives an agreed percentage of any final settlement or court award. If your case yields no compensation, you owe nothing. This structure ensures injury victims don’t pay out-of-pocket legal costs.

South Carolina has a three-year statute of limitations for filing personal injury lawsuits in most cases. Exceptions exist, however, so consult with legal counsel quickly to avoid missing critical filing deadlines.

While many injury claims settle out of court, your lawyer must be fully prepared to take your case to trial if a satisfactory settlement can’t be reached. Their negotiation proficiency and litigation experience greatly inform case outcomes.

South Carolina follows comparative negligence rules, allowing injury victims to pursue damages even if they share some fault, though any compensation could be reduced proportionally. A Myrtle Beach personal injury attorney can evaluate your legal options even with partial liability on your part.
