Our law firm is currently investigating cases of cancer insurance policyholders who may have only been paid a fraction of the benefits to which they are entitled.
The victims in these cases are people with supplemental cancer insurance policies who were guaranteed they would receive their benefits based on actual hospital charges for cancer-related treatments. However, some of the insurance companies failed to live up to their guarantees and changed the policy rules without notifying or gaining consent from the people who had bought the policies.
The unauthorized policy changes resulted in cancer victims receiving only a small amount of the money they needed for their bills. Before these policy changes occurred, insurance companies would, for example, pay a policyholder $12,000 in benefits if their hospital bills totaled $12,000.
The changes to how these benefits were paid out, however, drastically reduced the payout to the victims and their families. Using the above example, the unauthorized changes to the policies would allow an insurance company to negotiate a $12,000 hospital bill down to $5,000. The policyholder would then only be entitled to the negotiated amount, drastically reducing the payout from what the original policy promised. Instead of receiving $12,000 under the policy the cancer victim signed up for, they would only receive $5,000.
